The Role and Weaponization of Scientific 'Objectivity' in Gender Discourse and the Debate Over Transgender Rights

By Esme I. Smithson Swain - The label of ‘science’ or ‘biology’ can become somewhat of a trump-card in excluding trans people from civil rights, because many scientific (and pseudo-scientific) opinions are weaponized during transgender rights debates. This paper will therefore explore three dominant fields of thought in the gender/sex divide: biology, cognitive neuroscience, and queer theory. All three fields contribute immensely to our understanding of gender and sex, but the belief that any one discipline can objectively and unequivocally explain ‘gender’ can be dangerous. The theories...

The Process and Barriers to Legal Gender Transition: A Case Study Analyzing the Yogyakarta Principles

By Christian Borkey - Trans people experience a wide range of social and legal disadvantages, including an inconsistent, patchwork system - where one exists at all - to attain legal recognition of their gender. In the absence of such legal recognition, transgender people face more difficulty in navigating social or organizational institutions (ie bars, locker rooms, airports, care facilities, prisons, and other places that are sex-segregated or require an ID), less control over their healthcare, and a lower ability to gain and retain employment. Many states require one or more surgeries (including but not limited to...

The Criminal Justice System's Mistreatment of Transgender Individuals: A Call for Policy Reform to Assist a Marginalized Prisoner Community

By Stephenie King - While media coverage and politicians constantly acknowledge the inadequacies of the criminal justice system in managing victims and offenders of color and low socioeconomic status, the discussion about the failure of the criminal justice system towards transgender individuals, victims or offenders, is an issue that is rarely discussed. Transgender individuals have experienced a history of mistreatment and prejudice by traditional society, including judicially, but with contemporary acceptance movements and a rise in openly trans figureheads and celebrities, some may think the history of mistreatment...

"The Danish Girl" (2015) and the De/Construction of Gender Identity

By Annalena Lorenz - Before, however, Lili’s “ailment” was merely referred to as insanity, schizophrenia, homosexuality or indeed perversion, a condition which needed to be cured by imposing the most extreme measures, such as radiotherapy. The pathologization persists, albeit under a different name (Gender Identity Disorder) and with less immoral remedies being prescribed. In other words, gender identity still is, and is likely to remain for yet some time to come, a prevailing issue in today’s discourse, while scholars and activists alike persist in their endeavour to change society’s...

Hegemonic Masculinity in "Boys Don't Cry" (1999)

By Renee S. Grozelle - The need for individuals to categorize themselves and others based on gender has guided the way individuals interact with one another throughout history. The construction of gender, particularly when it comes to young males, has led to the amplification of negative characteristics associated with hegemonic masculinity. These negative characteristics have often been associated with an increase in the violence and aggression used in homophobic hate crimes committed by men. In order to highlight the negative impacts that hegemonic masculinity has on constructions of gender and sexuality, the film...

With REAL ID, Privacy Concerns for the Transgender Community

By Tonei Glavinic - The level of data collection mandated by the REAL ID Act of 2007 should raise concern for all American citizens who enjoy their privacy, because it mandates unprecedented levels of data collection and an equally unprecedented level of nationwide access to that data (EPIC, 2007, 14). There are a some sectors of the population, however, that are particularly at risk from the expanded collection and accessibility of personal information. EPIC provides one example: survivors of family violence, who could be easily tracked if an abuser gained access to any DMV or law enforcement database (2007, 15...

Research Shows Lack of Support for Transgender and Gender-Nonconforming Youth in U.S. School Systems

By Tonei Glavinic - Transgender children are some of the most vulnerable students in America’s schools. Nobody knows how many there are, and very few educators know what to do with them. Despite extensive advocacy efforts, trans youth are subjected to bullying and harassment in the classroom; diagnosed with nonexistent learning disabilities and psychological problems; and generally misunderstood by their doctors, teachers, and classmates. As a result, these students get lower grades than their classmates and are less likely to pursue higher education. The lack of a basic understanding of trans youth puts them...
